Please read this document carefully. By signing this Waiver and Release of Liability, you acknowledge that you understand and agree to its terms.

Acknowledgment of Risk

I understand that participating in fitness activities, strength training, cardiovascular exercise, personal training, group fitness programs, stretching, mobility exercises, and the use of fitness equipment involves inherent risks.

These risks include, but are not limited to:

• Muscle strains and sprains

• Broken bones

• Joint injuries

• Back and neck injuries

• Slips, trips, and falls

• Equipment failure or misuse

• Heat-related illness

• Cardiac events

• Illness, permanent disability, or death

I understand that these risks cannot be completely eliminated, even when reasonable precautions are taken.

I voluntarily choose to participate despite these risks.

Health Representation

I represent that I am physically able to participate in exercise and fitness activities.

I understand that Ironworks Gym is not providing medical advice and has not evaluated my physical condition.

If I have concerns regarding my health, I understand it is my responsibility to consult with my physician before participating.

I agree to immediately stop exercising and seek medical attention if I experience dizziness, chest pain, unusual shortness of breath, severe pain, or any other concerning symptoms.

Assumption of Risk

I knowingly and voluntarily assume all risks associated with my participation at Ironworks Gym, including risks arising from:

• Use of exercise equipment

• Participation in fitness activities

• Personal training

• Group instruction

• Independent workouts

• The actions of other members or guests

• Ordinary conditions commonly associated with fitness facilities

Release of Liability

To the fullest extent permitted by California law, I release and hold harmless Ironworks Gym, its owners, employees, contractors, trainers, volunteers, agents, successors, and assigns from claims, demands, causes of action, damages, losses, or expenses arising out of or related to my participation in activities at Ironworks Gym, except where prohibited by law.

This release applies to claims for personal injury, property damage, illness, disability, or death arising from ordinary negligence to the extent permitted under applicable law.

Nothing in this agreement releases Ironworks Gym from liability for gross negligence, reckless conduct, or intentional misconduct where such liability cannot legally be waived.

Equipment Use

I agree to use equipment only as intended.

If I do not know how to use a piece of equipment safely, I will ask a member of the Ironworks Gym team before using it.

I understand that I am responsible for exercising within my own abilities.

Personal Property

I understand that Ironworks Gym is not responsible for lost, stolen, or damaged personal property brought onto the premises.

I assume all responsibility for securing my belongings.

Personal Training

If I participate in personal training or coaching, I understand that trainers provide instruction based on the information I provide.

I agree to immediately disclose any injury, pain, medical condition, or limitation that may affect my ability to exercise safely.

Guests

If I bring a guest to Ironworks Gym, I understand that each guest must complete any required waivers before participating in gym activities.

I understand that I remain responsible for ensuring my guests comply with gym policies while accompanying me.

Photography and Video

I understand that security cameras may be in operation throughout portions of the facility for safety and security.

I understand that members may occasionally appear incidentally in photographs or videos taken within the gym by Ironworks Gym for promotional purposes. Ironworks Gym will make reasonable efforts not to identify members without their permission.

If I do not wish to appear in promotional photography or video, I may notify Ironworks Gym in writing, and reasonable efforts will be made to honor that request.

Emergency Medical Care

If I become injured or experience a medical emergency while at Ironworks Gym, I authorize staff to contact emergency medical services on my behalf.

I understand that I am responsible for any medical expenses resulting from treatment or transportation.

Compliance with Gym Rules

I agree to follow all posted gym rules, membership policies, and instructions provided by Ironworks Gym staff.

I understand that failure to comply may result in suspension or termination of my membership.

Severability

If any provision of this agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law

This agreement shall be governed by the laws of the State of California.

Electronic Signature

I acknowledge that by signing electronically or in writing, I certify that:

• I have carefully read this Waiver and Release of Liability.

• I understand its contents.

• I understand that I am giving up certain legal rights to the fullest extent permitted by law.

• I voluntarily agree to these terms.

• I am at least 18 years of age, or this agreement has been signed by my parent or legal guardian.
